在十八世纪中后期德国罗马法学重新秩序化之际，作为哥廷根法学派（Die Göttinger Rechtsschule）的领军人物，Johann Stephan Pütter（约翰•史特凡•普塔）的法学方法论革新是推波助澜的其中一股主要力量，对十九世纪德国法学体系形成有重大贡献。本文即旨在检视Pütter法学方法论的“秩序”（Ordnung）观念，包括其“整体与部分”思维、“一般与特殊”思维、“权利义务本位”思维、“发生史”思维、“认知顺序”思维，以及介绍他就罗马私法教学所提出的优化教学法，并对其“秩序”思想的起源与影响，尤其是它与“一般法学”以及十八世纪中后期萌芽的“总则”理念之间的关系，加以评述。

As a leading figure of the Göttingen School of Law (Die Göttinger Rechtsschule), Johann Stephan Pütter’s innovated Legal Methodology was one of the main forces that contributed to the German Roman Law “re-ordering” occurred in the mid to late 18^th  century, as well as to the formation of the German Legal System in the 19^th century. This paper aims to examine the idea of Order (Ordnung) in Pütter’s Legal Methodology, including the "whole-part" (Ganzes-Teil) thinking, the “general-special” (allgemeine-besondere) thinking, the “right-and-obligation-centered” thinking, the “genetic” thinking, the “cognitive sequence” thinking and the improved teaching method (Lehart) of Roman Private Law proposed by him, as well as to review the origin and influence of his conception, especially its relation with the idea of “General Law” and General Part (allgemeine Teil) emerged in the mid to late 18^th century.
