Abstract	《澳門民法典》第245條規定, 如錯誤涉及構成法律行為基礎之情事, 則適用有關情事變更的規定撤銷或變更有關法律行為. 本文的目的即是對這一雖然短小但包含多個法律概念的條文進行解釋. 為此, 本文從與本論題相關的一些案例出發, 探討不同時期的法學家為解決有關問題所持的契約必須履行、善意、衡平等核心價值, 在這些原則的不斷斗爭和妥協下所形成的諸如情事不變條款、前提假設論、不可預期論、行為基礎、合同落空理論、共同錯誤、風險分配等命題和話語, 尤其是行為基礎理論,以及對澳門立法有重要影響的各國所作出的不同立法選擇, 最後在此基礎上提出對《澳門民法典》第245條的解釋建議.
