| Abstract | 刑事拘传与拘留制度的修改与完善应当以短期限制人身自由强制措施体系为视角， 明确界定拘传与拘留的制度功能。拘传应当实现对“经合法传唤无正当理由不到场的犯罪嫌疑人、被告人强制 到场” 的功能， 废除现行“径行拘传” 制度及延长拘传期限至２４ 小时的规定。拘留制度在短期限制人身自由强制措施体系中发挥主要作用， 实现“对现行犯的无证拘留”， “对非现行犯的有证拘留” 以及特殊情况下“对非现行犯的无证拘留” 的功能。 |
