Abstract | The Special Administrative Region of Macao is an independent jurisdiction within the People’s Republic of China. Due to several centuries of Portuguese administration, Macao’s legal system is very similar to the Portuguese system. In Macao, civil medical liability is defined by Law 5/2016, which creates a special regime for healthcare professionals, slightly different from the general rules of the Civil Code. Criminal liability is governed exclusively by the Criminal Code, which provides specific criminal penalties for crimes committed by medical practitioners while they are engaged in their duties, as healthcare workers. An overall appraisal of medical liability in Macao indicates that it has some good and innovative ideas, but these ideas are not properly executed. Medical liability seems to be something that exists on paper but not in day to day judicial practice, leading to an extremely reduced number of studies and caselaw in this domain. |
