Abstract

Law reform in Latin America has been a consequence of the constant legal evolution envisioned in the region. Largely originating from the Continental Law system, Latin American countries have been seeking to promote reforms with the aim of meeting the aspirations of legal development. Brazil, since 1988, has stood out in the production of legislation, with important reforms in its legal system that largely reflect what is happening in Latin America. For that, it uses a constitutional system that promotes legislative innovation, but also the alteration of existing norms. In this sense, this chapter analyses and demonstrates how law reform occurs in Latin America, using the Latin American model in general, and the Brazilian model, for this purpose. In the same order, it presents the legislative and constitutional procedures for law reform, emphasising the congressional commissions that deal with legislative advances. Finally, it discusses the reasons and challenges faced in Latin America for law reform.
