It is questioned, with reference to the protection of the fundamental rights of the subtracted minor; the probative difficulties underlying the crime of child abduction; the presumption of innocence in favor of the defendant; the anticipation of criminal procedural protection and the taking of the minor’s statements the intensity and relevance of the injury, compared to a victim who is characterized by his vulnerability. In terms of conclusions, it is observed that the factual reality underlying subtraction requires the introduction of more effective and comprehensive legal mechanisms of guardianship to prevent non-compliance with court decisions, with the aim of strengthening the protection of children and parents victims of this type of crime within the framework of the exercise of parental authority.
