Abstract | A importância da Medicina Tradicional Chinesa (MTC), de origem chinesa, tem crescido gradualmente nos últimos anos, quer nacionalmente quer internacionalmente. Essa importância pode ver-se na WHO Traditional Medicine Strategy 2014–2023, que se destina a reforçar o papel que desempenha a medicina tradicional, mesmo tendo um âmbito mais abrangente do que a MTC de que aqui se trata, com vista a manter a saúde da população dos Estados-Membros da Organização Mundial de Saúde.

Other Abstract | The importance of Traditional Chinese Medicine (TCM), of Chinese origin, has gradually grown in recent years, both nationally and internationally. This importance can be seen in The WHO Traditional Medicine Strategy 2014–2023, which aims to reinforce the role that traditional medicine plays, even with a broader scope than the TCM mentioned here, in order to maintain the health of the population of the member states of the World Health Organization.
In Portugal, we have Law No. 45/2003, of 22 August (Law on the Basic Framework for Non-Conventional Therapeutics), Law No. 71/2013, of 2 September (Access to Professions in the Scope of Non-Conventional Therapeutics Conventional) and Ordinance No. 207-G/2014, of 8 October, which specifically regulates TCM within the scope of its competence, which demonstrates the attention that the Portuguese government has dedicated to TCM. As TCM’s activities are practiced in Portugal, MTC professionals may have doubts about whether their medical intervention or treatment could be the cause of civil liability from the beginning of the consultation until the end of the treatment. These hesitations are justified by the fact that, for example, they do not know, in most cases, what information they must provide to their users to avoid violating the right to informed consent, in which situation the diagnostic error is legally unacceptable, which civil liability exists in case of application of an inappropriate method, whether an acceptable failure in the execution of the treatment is liable to generate civil liability, etc.
In Portugal there is no author who has specifically studied or investigated civil liability for the acts of MTC professionals. The existing doctrinal resources relate to the non-conventional medicine, which encompasses other therapies in addition to TCM, and not specifically with the latter. In view of this, we can say that this is a new topic that needs to be deepened. This research aims to dogmatically analyze civil liability in MTC, assessing whether, under the Portuguese law, MTC professionals can be held civilly liable for acts performed from the beginning of the consultation until the end of the intervention or treatment. |
