| Abstract | “Restorative justice” has significant implications for criminal justice policies worldwide. Examining major criminal procedural law reforms in China from 2012 to the present, we find that four newly established institutions reflect a strong ideology of restorative justice. These legal mechanisms collectively constitute what is commonly referred to as “Chinese-style restorative justice”. While the essence of Chinese-style restorative justice aligns with other countries, such as advocating for reparative behaviour of the offenders, victims’ right to participate and achieving restorative outcomes, it also possesses unique characteristics based on China’s specific context. There is room for further refinement within the legal provisions that underpin Chinese-style restorative justice. Future legal reforms in China’s criminal procedure should closely adhere to the requirements of restorative justice, taking into account the needs of all stakeholders, including offenders, victims, and communities, to better achieve the restorative effects within the existing legal framework. |
