Abstract | This paper aims to examine the subjective requirements for voluntary limitation on personality rights in Macau civil law (Article 69 paragraphs 2 and 3 of the Macau Civil Code). Regarding the consent given by the personality right holder, both the preliminary draft and the current provision adhere to the “theory of factual capacity of discernment” instead of the “theory of legal capacity to act”. However, while the preliminary draft considers “age of 18 years” and “discernment” as alternative requirements, the current provision treats them as cumulative requirements. This solution prevents people under the age of 14 from validly imposing voluntary limitations on personality rights of low importance in daily life, thereby prevents them from excluding the illegality of the counterparty’s act. This result may discourage others to interact with them, which is obviously harmful to them and contrary to the ratio iuris of protecting minors. Hence, Article 116 paragraph 1 (b) should apply analogously to dispositions of personality interests of minor importance to validate such limitations. Regarding the objection raised by the holder of personality right, the current law adopts the “theory of dual competence” (Theorie der Doppelzuständigkeit), granting veto right to those under the age of 14, thereby invalidating the consent given by the legal representative, in order to uphold their autonomy of personality. |
