| Abstract | 本文旨在检视澳门地区的姓名构成规范。此等规则可分为四类，要旨如下：其一，在语种限制上，民事登记姓名以罗马字母为必要，只有“仅罗马字母”与“汉字＋法定罗马拼音”两种形式。汉字与拼音必须对应，但当事人可申请在身份证上加上别称。其二，在结构限制上，姓名由姓氏、名字，与或有符号构成，但似应容许只有名字。其三，在字数限制上，有别于旧法，即使是罗马字母姓名，现行法亦不设限。其四，在用字限制上，除非父母不明或特殊情形如“姓氏捐助”或受父母虐待抛弃，否则姓氏须从父、从母，或并从父母。惟父母姓氏合成的“新复姓”不得再被合成。姓名语义不限，但父母为子女起名受制于公序良俗，以免对孩子成长有负面影响。总的来说，澳门地区的姓名构成规范既反映了澳门地区与我国其他区域的密切联系，也反映了澳门地区长久以来华洋共处的特质。 |
| Other Abstract | This paper aims to examine the naming rules in Macau law. These rules can be divided into four categories, and the gist is as follows: First, in terms of language restrictions, names in civil registration must be in Latin alphabet, and there are only two forms, i.e., "Latin alphabet only" and "Chinese characters with legal Romanization". The Chinese characters and their Romanization must correspond to each other, but it is possible to apply for adding another name on the ID card. Second, in terms of structural restrictions, a name consists of a surname, a given name (first name), and symbols if any, but it seems to be allowed to use only the given name. Third, in terms of word number restrictions, different to the old law, the current law does not set a limit for it, nor even for the name in Latin alphabet. Fourth, in terms of word restrictions, unless the parents are unknown or there are special circumstances such as "surname donation" or parental abuse or abandonment of children, the surname must be the one from the father, mother, or both parents. However, the "new compound surname" formed by combining both the parents' surnames cannot be combined again. There are no restrictions on the meaning of the words used, but the name given by the parent to the children should be subject to the prohibition of abuse of rights, so as not to have a negative impact on the growth of their children. In general, the naming rules in Macau law reflect both the close ties between Macau and other regions of China, and the long-standing coexistence of Chineses and foreigners in Macau. |
