| Abstract | 醫療人工智能在實際診療、康復管理等醫療活動應用中與醫療專業人員存在知識廣度、推理與判斷、情感和人際交往等多方面的差異，其特殊性質與作用機理引發了醫療領域法律與倫理的雙重考量。 本報告首先從醫學成像、疾病輔助診斷系統和醫療機器人的主要應用類型角度，分析了人工智能在醫療健康領域應用的歷史發展和現實性規制困境。儘管醫療人工智能應用具有巨大潛力，但也涉及一系列法律適用不足與倫理性風險，尤其可能對醫療工作機會造成衝擊，並侵犯人類尊嚴。 為此，本報告著重提出了醫療人工智能治理規範的完善方案，包括明確定位醫療人工智能客體、釐清醫療損害侵權責任制度、構建人工智能醫療倫理治理路徑，以及引入強制性人工智能醫療保險計畫和賠償基金專案等措施。 這些規範旨在解決醫療人工智能應用中的倫理和法律問題，保障醫患雙方的權益，促進醫療人工智能技術的可持續發展。 |
