Global 'Convivencia' and the Reform of the International Institutional System | |

Abstract | The early years of the 21st century witnessed a global race for the development of emerging technologies commonly referred to as ‘”artificial intelligence” (AI). This race is often said to be led by the People’s Republic of China and the United States with the European Union and other countries trying to catch up. At the same time, the rapid development of AI has also revealed serious dangers and even potentially existential risks, which are becoming exacerbated by the creative combination of AI with other technologies. AI-related dystopian post-human scenarios have led to a growing awareness about the need for binding laws or regulations to minimize these risks. In this regard, the dominant narrative is now one of a “global race for the regulation of AI”, while it should, ideally, be more of a race towards the best efforts for the “global regulation of AI”. Moreover, the future global regulation of AI has to be linked to other global governance issues, such as notably those of laid down in the Sustainable Development Goals (SDGs). All of these problems combined, the paper advocates, cannot be successfully addressed based on the present international institutional framework, which was established in 1945 and is highly fragmented. Instead, it needs a drastic reform with a view of establishing a more coherent global institutional framework. This goal, however, can only be achieved if a cognitive change will take place, one which must be supported by comparative law and guided by the spirit of global coviviencia. |
