Abstract | The present study evaluates if it is possible to achieve a common European standard of care for cyber medicine, namely for the practice of medicine using Internet. Firstly, it is imperative to define which will be the proper standard of care for cybermedicine, since doctor-patient relationships, doctor's obligations and the existing risks are different from traditional face-to-face medicine. Secondly, the study will discuss if it is reasonable to expect a common standard of care, valid for all European countries. The European Union congregates different legal orders and deontological sensibilities, therefore, practices such as prescribing a drug, answering to an e-mail or performing a diagnosis may become very 'tricky' within a cybermedical context beyond the national borders of European member States. |
