AbstractWith the reduced costs for DNA-sequencing and the rapid development of technology used for genetic testing, genetic test and diagnosis services have been increasingly approachable and affordable to the Chinese patients and customers. The emerging market brings huge profit potentials, but also imposes many legal challenges to the Chinese government. This article, by reviewing existing Chinese legislation for the supervision of the genetic testing services, protection of genetic data, and guidance for genetic testing counseling, reveals Chinese government’s reactions to the booming genetic testing industry and the regulatory measures that are and will be taken for the administration of testing services. The discussions on the challenges for the current legal framework indicate that regulatory improvements should be made to ensure the clinical validity of genetic testing, the protection of the confidentiality of genetic information, and the professional interpretation and explanation of genetic test results.
