Using the many special features of the Macau SAR, this paper addresses the wider implications of cultural rights as laid down inter alia in the International Covenant on Economic, Social and Cultural Rights (ICESCR) for the regulation of international trade and vice versa. To this end, it looks particularly at the so-called “right to adequate food,” combining considerations of food security and food safety in the context of an increasingly globalised food industry. The regulatory challenges deriving from the fragmented international legal order, divided notably into “trade issues” and “non-trade” or “trade-related” issues, shall be exemplified by the recent adoption of a new food safety law in the Macau Special Administrative Region (Macau SAR) of the People’s Republic of China (PRC), as both a special administrative region of the PRC and, in line with the competences laid down in the Basic Law, also as a member of the international community, and notably, the ICESCR and the World Trade Organization (WTO).
